In pursuance of powers granted under the above Acts and Order the
Department of Local Government and the Environment does hereby
APPROVE the application made by you on behalf of

Extraction of sand and gravel as an extension to existing quarry, land to the
west of the A16 and south of existing sand and gravel quarry, Point of Ayre,
near Bride.

which was considered on the 20 March 1998, subject to the compliance with the
conditions or modifications specified on the attached schedule, numbered 1 to
8.

Note 1: This permission refers only to that required under the
Town & Country Planning Acts and does not include any
consent or approval under any other enactment, byelaw,
order or regulation.

Note 2: NO WORKS MAY BE COMMENCED UNTIL SUCH TIME AS -

a) the time for requesting a review of the initial
decision has expired; or
b) any review of the initial decision has been
completed; or
c) the time for requesting an appeal in relation to any
decision at review has expired; or
d) any appeal has been completed.

The development hereby permitted shall be commenced before the
expiration of four years from the date of this notice.

The working and restoration must be undertaken entirely in
accordance with plans reference:

P2/1455/6
P2/1455/7 and
P2/1455/8

The new footpath to be created as a replacement for the existing
which runs through the middle of the site, must be created prior
to the commencement of extraction in Block 2. Such new footpath
must be formed such as to be suitable for pedestrian traffic only
and not motorcycles or motor vehicles.

The working hours of the operation shall be only between 7 am and
5 pm Mondays to Fridays inclusive and 7 am and 12 noon inclusive
on Saturdays.

The Manx Museum and National Trust must be informed of the date
when building work is to commence and be given access at all
reasonable times and reasonable opportunity, to inspect the site,
observe all excavations and investigate any archaeological
features exposed.

All of the World War II remains lying within the site must be
fully recorded and photographed prior to and during extraction.
The Manx Museum and National Trust (Manx National Heritage should
be consulted in this respect).

NOTE 1: The applicant is advised to consult the Department of
Trade and Industry with respect to the issue of a licence to
extract minerals in accordance with the relevant legislation.

NOTE 2: The applicant is advised to consult and maintain
communication with the Department of Agriculture, Fisheries and
Forestry Wildlife Committee in terms of the provisions of the
Wildlife Act 1990 (habitat and wildlife protection) and other
relevant policies (International Conference on the Conservation
of Wetlands and Waterfowl (Ramsar 1971), Convention on the
Conservation of Migratory Species of Wild Animals, European
Agreement on the Conservation of Bats).

During the process of extraction, the applicant must undertake
continuous monitoring to ensure leachate from adjacent operations
do not contaminate the lake as it is being created or mineral
reserves earmarked for future workings. If the monitoring
demonstrates that leachate is contaminating the site, appropriate
measures must be agreed with the Planning Committee and
undertaken as directed by them.

Works on the proposed earth bund adjacent to the A16 must be commenced when working in Phase two is started. The bund must be
turfed preferably with existing grass turf from the site not with grass seed.

Isle of Man Planning Scheme (Development Plan) Order 1982.
