Please reply to the Chief Executive Our ref: KAK/MC 26th November 2008. Dear Sir/Madam,

ON APPEAL: PA08/672 – Mrs. E. J. Johns – Approval in principle to the erection of a dwelling and garage, Part of garden of Shan Vallah, The Colony, Port Lewaigue, Maughold

I refer to the recent appeal hearing in respect of the above planning application.

In accordance with the provisions of the Town and Country Planning (Development Procedure) Order 2005, I am enclosing herewith a copy of the report of the person appointed to hear this appeal.

The Minister has considered the report, concurs with the appointed person’s conclusions, and accepts the recommendation that the appeal should be dismissed. Accordingly, he has directed that the approval of the application under Article 6 of the Town & Country Planning (Development Procedure) Order 2005 should be confirmed but varied by the addition of the conditions set out in the schedule attached to the inspector’s report. Formal notice of this decision is attached.

### The Town And Country Planning (Development Procedure) Order 2005

In pursuance of his powers under the above Act and Order, the **MINISTER** for Local Government and the Environment, following report by the appointed person, does hereby **APPROVE** the application by Mrs. E. J. Johns – Approval in principle to the erection of a dwelling and garage, Part of garden of Shan Vallah, The Colony, Port Lewaigue, Maughold, subject to compliance with the following conditions:-

1. This approval is in principle only and will remain valid for a period of two years within which time no development may take place until such time as details of the reserved matters (siting, design, external appearance, internal layout, means of access, landscaping) have been approved by the Planning Authority. Such reserved matters should form the subject of a single application.

2. This approval relates to the land defined by the red line as shown on drawing No. 01 rev. A, date-stamped the 31st March 2008.

3. Any reserved matters planning application must include provision for vehicular sight lines of a minimum of 2 metres by 18 metres.

4. Any reserved matters planning application must include provision for the parking of a minimum of 2 cars within the curtilage of the application site.

5. Any reserved matters planning application must include provision to allow a car to enter and exit the application site in a forward gear.

6. The dwelling hereby permitted shall not be occupied until works for treatment and disposal of sewage have been provided on site in accordance with details to be submitted to and approved in writing by the planning authority.

7. The dwelling hereby permitted shall not be occupied until works for the disposal of surface water have been provided on site in accordance with details to be submitted to and approved in writing by the planning authority.
