#### The Site

1. The site is the curtilage of Primrose Lodge, an existing dwelling situated on the western side of the A2 Laxey to Ramsey road, just to the south of the Rest and Be Thankful, together with a field to the south and west. There are two buildings on the site - Primrose Lodge itself and a stone outbuilding which has been converted to tourist accommodation. Planning permission was also granted in 2008 for the change of use of the garage to a beauty salon (see below).

2. The main dwelling is a handsome house of traditional proportions and projecting two storey bay windows. Access is directly off the A2 in an otherwise uninterrupted hedge where there are a number of trees growing out of the top. Visibility is not ideal due to the alignment and slope of the highway.

#### The Proposal

3. Proposed is the erection of a sign to advertise the beauty salon. The sign will be a timber bracket which stands 1.5m above the ground and alongside the existing stone pier which is slightly less tall. The sign will hang from the top part of the bracket and will advertise "Primrose Beauty Treatments - tel 450305" and the other side a list of treatments which it is unlikely a passing motorist would be able to read. The sign itself will be 600mm by 400mm. Lettering will be hand written.

#### Planning Policy And Status

4. The site lies within an area of High Landscape Value and Scenic Significance and Woodland on the Town and Country Planning (Development Plan) Order 1982.

5. The Strategic Plan contains the following references to advertising in the countryside:

"6.6.3 Within rural areas, advertisements can be disruptive features which affect adversely the appearance of the landscape and the countryside, Lighting can pollute the night sky and may be contrary to nature conservation interests."

6. General Policy 8 states: "Within rural areas the display of external advertisements will be permitted only where:

a) They are located on or directly next to the premises to which they relate:
b) They do not detract from the appearance of either the immediate area or the landscape;

c) They are normally constructed of traditional materials unless the nature of the display or location would render such materials inappropriate; d) Any illumination, which will be permitted only where it is essential, is kept to a minimum and is so hooded as to prevent undesirable escape of light; e) They are located so as not to cause a highway safety hazard; and f) Any illumination will not have an adverse effect on areas of ecological value."

### Planning History

7. The site has been the subject of a number of applications, the only one of which is relevant to the consideration of this application is that for the conversion of the garage to the beauty salon - PA 08/0835. Conditions required that the beauty salon not be operated on Sundays and that no signage be erected without planning permission.

### Representations

8. Highways and Traffic Division indicate that there are no adverse traffic impacts from the proposal.
9. Maughold Parish Commissioners indicate that they do not oppose the application.
10. A resident of Douglas queries whether the use has approval (it has) and why two signs are necessary (there is only to be one).

### Assessment

11. The sign is nicely designed and will not be out of keeping with the site. The use which the sign is advertising is legitimate and there are no objections from anyone with a direct interest in the development. The proposal is considered to comply with the provisions of the Strategic Plan and as such the application is recommended for approval.

### Party Status

12. The local authority, Maughold Parish Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
13. The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
14. The resident of Douglas is not affected by the proposal and as such should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of signage as shown in drawings PTA 52 01A and PTA 03B both received on 8th November, 2011.

C 3. If the use to which the signage relates ceases, the signage and supporting posts must be removed.

I confirm that this decision accords with the appropriate Government Circular delegating functions to Director of Planning and Building Control / Development Control Manager.
