## Officer's Report

### Introduction

1. This application seeks permission for removal of a chimney stack and roof repair works to an old mill in Laxey Conservation Area. The proposal is considered to be acceptable and is in accordance with the relevant policies of the Isle of Man Strategic Plan.

### The Site

2. The application site is the curtilage of Glen Mill, Glen Road, Laxey which is currently used as offices and warehousing. The site is in the Laxey Conservation Area.

### The Proposal

3. The application seeks approval for the removal of chimney stack which is on the side elevation. Once the chimney is removed, the stonework behind will be repaired. Also proposed is the removal of a small lean to roof so repair works can be carried out on the timber underneath. The roof would then be re constructed; the concrete tiles would be replaced with Cambrian tiles similar to natural slate.

### Development Plan Policies

6. The application site is in an area zoned as Mixed Use – Residential, Industrial, Office, and Recreational identified on the Laxey and Lonan Area Plan 2005. It is also within the Laxey Conservation Area. It is appropriate to consider Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007).

### Consultations

7. Laxey Commissioners have recommended that the application be approved.

8. Highways Division has not commented

## ASSESSMENT

9. Given the nature of the application, it is appropriate to consider Environment Policy 35, which states:

"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character or appearance of the Area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

10. The application is made up of two parts, the removal of the chimney stack and the roof repair works.

11. The chimney stack is cracked and has not been in use for a number of years. It is considered that the chimney stack does not significantly contribute to the character and appearance of the property or the Conservation Area. It is judged that the removal of this would not have a harmful impact in terms of character and appearance.

12. The roofing repairs would include the removal of the existing lean to roof, repairing the timber underneath and replacing the concrete tiles with Cambrian tiles which are similar to natural slate. It is considered that this would enhance the appearance of the building as the proposed materials would be more appropriate than the existing.

13. It is judged that the proposed development would contribute to the character and appearance of the property.

14. The Conservation Officer was satisfied that the proposed development would not have a harmful impact on the character and appearance of the Conservation Area.

15. For the above reasons the application is considered to be acceptable and is recommended for approval.

## PARTY STATUS

16. The local authority, Laxey Commissioners is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
