# Officer Ancillary Assessment Notes

The site is designated as Private Goodlay or Parkland or the Iam Dev order 1982. Therefore the site is not designated for dev. A- Due to this designation e ta proposed dev, GP3, EP1 or the Iam se require consideration. - When the DA considers applications which proposal ancillary are we first of all look at the size of the level of accommodation which is proposed (or could be) within the unit. - It is clear that this proposed with a bedroom bathroor lounge/Dining, kitchen & a store could provide a separate unit which would not relay on the main (hellad) house for any provision. - The DA considers ancillary in planning terms means that said building is used by e for the people of the main property in a secondary manner & the whole planning unit remains as a single unit of accommodation. It is not consider you could have an entirely independent property ancillary to another. - How a building is used is also important, whether they are features, friends, if the unit is used independently from the main dwelling house this usage is not ancillary. A Part 7.5 of the appellants stated they indicate the area is designed to be self contained - that the small flat could accommodate visitors, elderly relations or a young person or couple saving for a home of the own. - parents - It needs to be remembered that pp runs with the land and the building will remain long after the current owner came to have an interest in the property. The long term use of the building must be a consideration in the determination of the application. If in time the building is used independently from sandgate house, then this independent the could become lawful. - The use of a self contained unit by a member of family or relative or the main dwelling house does not in itself render it ancillary to that property. There would be no matter difference in nature between an unrelated family using the property & relatives using it. Consequently the same criteria that is used to assess an application for a new property should be used to assess the application. - A condition could be attack with prevent the building being occupied as a separate dwelling, but concern is raised as the unit proposed would create a separate independent dwelling & therefore such a condition would be breached as soon as the dwelling is occupied. also if the flat is built then the sandpaper house is demolished. The unit is no longer ancillary. - For the reasons the application was refused. ??? - Who would used the unit? Mr Carpenter Trist guest age (ancillary)
