### Site

The application site is the residential property of No.25 All Saints Park. The area is zoned as proposed residential within the Laxey and Lonnan Local Plan. The site is not located within a Conservation Area.

### Proposed Development

This application is seeking permission to erect a boundary wall with fencing to replace the existing timber fencing.

### Planning Status And Relevant Policies

### Planning History

There have been a number of previous planning applications that are considered material to the assessment of this current planning application.

11/01023/B - Erection of a conservatory to rear elevation of dwelling – pending consideration

11/00045/B - Erection of a two storey extension and vehicular access amendments - granted

### Representations

Lonan Parish Commissioners recommends approval of the application. Highways Division of the Department of Infrastructure do not oppose the application Isle of Man Water and Sewerage Authority do not object to the application.

### Assessment

The key issue for this application is whether the proposed boundary wall and fence will impact on the visual amenities of the locality.

The application site currently has part of a boundary wall and fencing. This application is proposing to continue that wall and fence. The neighbouring property to the rear of the application site has a similar wall and fence arrangement. It is considered the proposal will not adversely affect the visual amenities of the locality.

### Recommendation

It is recommended that planning permission be granted subject to conditions.

### Party Status

The local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Highways Division is part of the Department of Infrastructure of which the planning authority is part of. As such, the Highways Division cannot be afforded party status in this instance.

Isle of Man Water and Sewerage Authority have not commented on planning matters and as such should not be afforded party status.
