### Officer's Report

#### The Site

The site is the curtilage of an existing terraced dwelling situated on the south eastern side of Victoria Road, between Bay View Road and Cronk Road. The property is a two storey dwelling with ground floor flat roofed angular bay window and a triangular dormer window in the front pitch. At the rear there is a three storey annex whose height is just less than the eaves of the rear elevation and which is attached to a similar structure at the rear of the adjoining property to the north east.

The windows in the property are a mixture of plastic casements and timber framed sliding sashes. The ground floor bay still has its original sliding sashes, the remainder of the windows are plastic framed casements. The streetscene has a mixture of original sliding sashes and plastic casements - numbers 3, 11 and 13 having plastic windows throughout and numbers 7, 9, 15 and 17 having their original timber framed sliding sashes.

Each of the properties has a small front garden with low masonry wall and the properties step up gradually, following the incline of the street.

#### Planning Status

The site lies within an area designated on the Town and Country Planning (Development Plan) Order 1982 and the draft Southern Area Plan as Residential.

The site also lies within a significant area identified on the draft Area Plan as worthy of consideration as a Conservation Area. This area includes Lime Street and the promenade and the area in between.

### The Proposal

Proposed is the replacement of the ground floor windows in the bay with plastic framed casements to match those in the rest of the house, and the replacement of an existing plastic framed casement window in the rear elevation with one which allows the lower portion to open.

Also proposed is the replacement of the existing dormer window with a plastic framed window of the same size as the existing but with a different opening style (side hung).

### Planning Policy

Planning Circular 1/98 includes the following:

"BUILDINGS ERECTED BEFORE 1921 AND NOT FALLING WITHIN CATEGORIES a OR b WHICH HAVE LARGELY RETAINED THEIR ORIGINAL CHARACTER

In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows.

Windows not part of the principal elevations and which are not readily visible from a public thoroughfare should preferably have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in their construction.

### Other Buildings Erected Before 1921

Replacement windows should preferably be the same as or similar to the originals in the pattern of the glazing bars. However, provided that the glazing pattern is retained, a more relaxed approach will be taken to the replacement of windows in such properties."

### Planning History

Planning permission has been granted for the plastic framed casements in numbers 11 and 13 under PA 95/1828 and 97/1305. Planning permission has been granted for the installation of replacement plastic framed sliding sashes under PAs 07/1784 and 11/0263 for numbers 8 and 17 respectively.

### Representations

Port St. Mary Commissioners indicate that they do not oppose the application.

### Assessment

The area, whilst a potential Conservation Area is a typical Victorian terrace where there have already been plastic casements installed in a number of the properties but the terrace has not lost its original charm which lies principally in the rhythm of the terrace and its doors and windows rather than the individual details thereof.

As such, it is considered that the proposal is acceptable.

### Party Status

The local authority, Port St. Mary Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
