### Officer's Report

#### The Site

The application site is the curtilage of an existing dwelling (Church Farm) which is situated on the eastern side of the A3 Malew Road opposite Great Meadow. The site accommodates the house, a detached garage and various outbuildings.

#### Planning Status

In terms of local plan policy, the application site is located within wider areas of land that is designated as i) open space; and ii) high landscape or coastal value and scenic significance under the Isle of Man Planning Scheme (Development Plan) Order 1982.

#### The Proposal

Proposed is the replacement of an existing conservatory which is 3.2m by 4.7m with one which is on the same footprint, the same length but 3.5m wide. The conservatory will have a slightly steeper pitched roof and thus be slightly taller - 3.2m compared with 2.6m. The new sun room will have a slated roof and stone dwarf wall.

Also proposed is the addition of a new window in the eastern gable. This is a small window - 0.7m by 1.2m and fitted with sliding sashes.

## Planning Policy

In terms of local plan policy, the application site is located within wider areas of land that is designated as i) open space; and ii) high landscape or coastal value and scenic significance under the Isle of Man Planning Scheme (Development Plan) Order 1982.

In terms of strategic plan policy, the Isle of Man Strategic Plan 2007 contains one policy that is considered specifically material to the assessment of this current planning application.

### Housing Policy 15 states:

"The extension or alteration of existing traditionally styled properties in the countryside will normally only be approved where these respect the proportion, form and appearance of the existing property. Only exceptionally will permission be granted for extensions which measure more than 50% of the existing building in terms of floor space (measured externally)."

## Planning History

Planning permission was granted for the erection of a greenhouse under PA 07/0853 and for alterations under PA 02/1823, 96/0090 and 97/1947. A garage was permitted under PA 97/0215.

## Representations

Highways and Traffic Division and Malew Parish Commissioners indicate that they do not oppose the application.

## Assessment

The proposed development is relatively modest and considered to be in keeping with the character of the dwelling. The proposal does not unduly affect public amenity, private amenity or highway safety and is concluded to satisfactorily accord with the provisions of Housing Policy 15 of the Isle of Man Strategic Plan 2007. The new window will not be publicly visible and the conservatory is more attractive and better finished than the existing.

It is recommended that the planning application be approved.

## Party Status

The local authority, Malew Parish Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
