### Officer's Report

#### The Site

The application site is the curtilage of 5 Hilary Road, Douglas which is a two storey mid terrace property which is situated on the northern side of Hilary Road. The application site is in the Woodbourne Road Conservation Area.

#### The Proposal

The application seeks approval for the installation of replacement windows and door in the front elevation. The windows would be white uPVC casements and the door would be a traditional style uPVC door finished with woodgrain affect and blue infill panels.

#### Planning History

The previous planning applications are not considered specifically material in the assessment of the current application.

#### Development Plan Policies

The application site is in an area zoned as "Predominantly Residential" identified on the Douglas Local Plan 1998. It is also in the Woodbourne Road Conservation Area. It is appropriate to consider Planning Circular 1/98 and Environment Policy 35 of the Isle of Man Strategic Plan (20th June 2007).

### Assessment

Environment Policy 35 of the Strategic Plan requires that proposed developments should preserve or enhance the character and appearance of the Conservation Area. Planning Circular 1/98 requires replacement windows must have the same sections and glazing bars as the originals.

The existing windows and door in the front elevation do not contribute towards the appearance of the street scene and are fairly unattractive. Although the windows would not have the original method of opening, they would be of the same design and opening as the adjoining property 4 Hilary Road. The replacement windows would have a 50/50 split which is similar proportions of sliding sash. It is considered that the replacement windows would enhance the appearance of the property.

The existing door is not of a traditional design, it is considered to have a harmful impact on the appearance of the property. The replacement door, although uPVC would be of a traditional design, which again would contribute to the character and appearance of the property and street scene in general.

For the above reasons the application is considered to be acceptable and is recommended for approval.

### Party Status

The local authority, Douglas Corporation is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
