### Officer's Report

#### The Site

The site is the residential curtilage of an existing dwelling situated on the western side of Malew Street to the south of Mill Street and The Crofts. The property is a modest Manx cottage, terraced with the properties on each side being of similar height.

The existing windows in the property are timber framed sliding sashes. The second floor has a single pane height top and bottom arrangement with three panes across: the first floor has two panes, one on top of the other with six panes in each and the ground floor has a wider aperture which has two one pane width side sliding windows and a central pair of sashes which each have four panes within it.

#### Planning Status

The site lies within an area designated on the draft Southern Area Plan and the Castletown Local Plan of 1990 as Residential. The site also lies within a Conservation Area.

#### The Proposal

Proposed is the replacement of the windows, replicating the existing with double glazed units but with the same glazing pattern. It would appear that the side lights on the ground floor windows are fixed and do not slide up and down as do the existing.

It is not specified in the application what the frame material will be but an application has been made for Grant Assistance under the Historic Buildings Scheme which would require timber framed windows.

### Planning Policy

As the property lies within a Conservation Area, Environment Policy 35 is applicable in this case:

"Within Conservation Areas, the Department will permit only development which would preserve or enhance the character of appearance of the area, and will ensure that the special features contributing to the character and quality are protected against inappropriate development."

Planning Circular 1/98 states:

### Buildings In Conservation Areas

If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare MUST HAVE THE SAME method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE THE SAME pattern and section of glazing bars and the same frame sections as the original windows.

Windows not readily visible from a public thoroughfare must have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in the construction.

### Planning History

The following applications have been submitted in respect of this property:

PA 10/1764 - installation of replacement windows to rear elevation and four rooflights - permitted PA 99/2368 - erection of rear porch and alterations - permitted

A grant application has been made for the present proposal to replace the front elevation windows.

### Representations

Castletown Commissioners indicate that they do not oppose the application.

### Assessment

The present windows are possibly the originals and as such any new windows should be sliding sash to match this, which is what is proposed. Regardless of the material, the sliding sash format will ensure continuity of the character of the property and comply with the provisions of EP 35 and Planning Circular 1/98.

### Party Status

The local authority, Castletown Commissioners are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
