### Officer's Report

#### Planning Status And Relevant Policies

Within the adopted Isle of Man Strategic Plan 2007, the following policies are considered to be relevant in the determination of this application: General Policy 2, paragraph 8.12.1.

#### Assessment

The application site is seeking planning permission for a dormer over the rear slope of the garage so as to allow the roof space of the garage to become a bedroom with an ensuite. The dormer will be partially visible from the public highway of Meadow Crescent; however a fair majority of the development will be obscured by landscaping. On balance, it is considered the proposal will not adversely affect the visual amenity of Meadow Crescent.

In respect of the impact on No.1 Horseshoe Avenue, the proposal would not encroach further to the neighbouring property; as it would not increase in height beyond the existing ridge line and with obscure glazing on the side elevation; the residential amenity of the neighbouring property of 1 Horseshoe Avenue would not be adversely affected by the proposal.

#### Recommendation

It is recommended that planning permission be granted subject to conditions.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.

The Highways Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates the erection of a dormer and th creation of a window opening as shown in drawing numbers 01 Rev C and 02 date stamped 28th April 2011 and email from Kevin Graham dated 1st July 2011.

C 3. The window to be formed in the north west facing wall must be glazed or re-glazed with obscure glass only.

C 4. No facing materials shall be used other than materials similar to those use on the existing building.

C 5. The roof of the dormer must be constructed using forticrete Centurion Low Pitch Roof Tile, as detailed in the email from Kevin Graham dated 1st July 2011.
