### Officer's Report

#### The Site

The application site represents the curtilage of 10 Stanley Road, Peel. The property is a three storey terraced dwelling which faces north east onto Stanley Road.

#### Planning Status

The site is located within an area identified as Mixed Use by the Peel Local Plan 1989. The site is also identified as being within the Peel Conservation Area. The application is for the replacement of windows and as such is to be assessed with regard to Planning Circular 1/98 'The Alteration and Replacement of Windows', specifically Policy 6 'Buildings in a Conservation Area', which states:

"If the original windows are in place they should preferably be repaired. If repair is impracticable, replacement windows which would be readily visible from a public thoroughfare MUST HAVE THE SAME method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE THE SAME pattern and section of glazing bars and the same frame sections as the original windows.

Windows not readily visible from the public thoroughfare must have the same or similar pattern of glazing, but not necessarily the original method of opening, whatever material used in the construction."

REPRESENTATIONS Peel Town Commissioners have indicated no objection to this planning application. The Highways Division have indicated no objection to this planning application.

## THE PROPOSAL

This application seeks retrospective planning approval for the installation of replacement windows to the rear elevation. The windows are PVC 50/50 split casement windows. The application also proposes the erection of a replacement conservatory (also retrospective).

## ASSESSMENT

Planning Circular 1/98 states that the replacement windows on a property in a location such as this should preferably have the same method of opening and same glazing bars as the original windows.

The original windows on the front of this property were timber sliding sash which were replaced with PVC casement windows (92/00168/B) which did not match the method of opening or glazing bar pattern. Although not sliding sash the current windows are an improvement on the windows that preceded them.

The rear elevation windows that are the subject of this application are not visible from public vantage points and in any case replicate the 50:50 split that the original windows would have displayed. It is judged that the windows do not have a detrimental impact on the appearance or character of the property or the Conservation Area.

The rear conservatory is modest and contained within the rear yard which is bounded by high stone walls. The structure is not visible to the public and does not affect adversely the amenity of adjacent properties.

RECOMMENDATION

It is recommended that the application be permitted.

## PARTY STATUS

It is considered that the following parties, who submitted comments, accord with the requirements of Planning Circular 1/06 and are therefore, afforded Interested Party Status:

Accordingly the following parties are not granted Interested Party Status:

The Highways Division and the Planning Authority are both part of the Department of Infrastructure. As such, the Highways Division cannot be afforded Interested Party Status.
