### Officer's Report

#### Site

The application site represents the residential curtilage 4 Ballamoar Cottages, Main Road, Ballaugh, which is a traditional two storey end terrace, located on the western side of the Main Road and east of the Ballaugh Bridge.

#### Proposal

The application seeks approval of the installation of replacement windows and front door to the front and side elevations.

#### Department Policies

The application site is within an area recognised as being an area of “white land” under the Isle of Man Development Plan Order 1982. The site is not within a Conservation Area; but is within an area zoned as High Landscape or Coastal Value.

Relevant policies include:
- Isle of Man Planning Scheme (Development Plan) Order 1982
- The Isle of Man Strategic Plan (20th June 2007)

#### Planning History

There are no previous planning applications which are considered relevant in the assessment and determination of this application.

## Representations

Ballaugh Commissioners have made the following comments:-
"No objections"

The Planning Authority has received no privately written representations objecting to the proposal.

## Assessment

The existing windows which are proposed to be replaced are a mixture of timber sliding sash windows (ground floor) and timber side hung (1st floor).

The proposal would result in the installation of uPVC sliding sash windows to the ground floor windows at the front (includes Georgian bars) and side elevations. The existing timber side hung windows will be replaced with uPVC top opening casement windows, which include a vertical bar.

Whilst the Planning Authority would prefer the use of timber as existing, the site is not within a Conservation Area, nor is the property a Registered Building.

The applicants are proposing uPVC sliding sash windows to the front and side elevations of the dwelling and are proposing to install windows to match the existing detailing of the existing windows at ground floor level.

The first floor windows will differ than the existing window; however, this is considered to be a betterment to the appearance of the property.

The front elevation is the most prominent elevation from the street scene and the proposals would have no adverse impacts upon character and quality of the existing property or the visual amenities of the street scene.

The door alterations again would match the existing in all respects except for material. It is considered the proposal to be unobjectible.

For these reasons it is considered the scheme would be acceptable and would not have a detrimental impact upon the visual amenities of the area, nor upon the property itself.

## Recommendation

Overall, for the reasons set out in this report, it is considered the proposals would comply with the relevant policies as indicated within the Isle of Man Strategic Plan and therefore it is recommended that the application be approved.

## Party Status

It is considered that the following meet the criteria of Government Circular 1/06 and should be afforded interested party status:

### Ballaugh Commissioners

The Department of Transport Highways and Traffic Division is now part of the Department of Infrastructure of which the planning authority is part. As such, the Highways and Traffic Division cannot be afforded party status in this instance.
