### Officer's Report

#### Planning Status

Within the adopted Isle of Man Strategic Plan, the following policy is considered to be relevant to the assessment and determination of this application: General Policy 2, Environment Policy 35

#### Assessment

The application site is located within a Conservation Area. The application is for a new front and awning.

It should be noted that the drawings show an awning with an advertisement, which would normal mean the awning would not be considered as part of this application as advertisement are controlled through separate legislation. However, the applicant’s agent have indicated that they would like the canopy to be considered as part of this application, as the lettering is indicative only.

In respect of the impact of the works on the character and appearance of the Conservation Area, the new shopfront will be constructed out of timber and glass. This will replace an existing metal and glass shopfront. The use of timber for the shopfront is an improvement on the existing structure. The proposed awning would replace the within canopy. The canopy would be a modest addition to the frontage. The proposed works would be enhancement to the character and appearance of the Conservation Area.

## Recommendation

It is recommended that planning permission be granted subject to conditions.

## Party Status

The local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Highways Division is part of the Department of Infrastructure of which the planning authority is part of. As such, the Highways Division cannot be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the installation of canopy and new shopfront as shown in drawing numbers 202, 203, 204, 308 and Conservation Area Statement prepared by KPP Architects date stamped 28th March 2011.
