## Officer's Report

### The Site

The application site represents the curtilage of an existing mid-terraced property, 28 Murrays Road, Douglas. The property is located on the north side of Murrays Road, opposite the junction with Bathurst Street.

At some point in the past, the building has been converted into 3 flats.

### The Proposal

Proposed is the installation of replacement windows and doors to the rear elevation and rear annexe.

The existing windows are sliding sashes and the proposed windows are white upvc casements. The replacement doors would be in white upvc.

### Planning History

There are no previous planning applications which are considered relevant in the assessment and determination of this application.

### Development Plan Policies

The application site is located within an area designated as Predominantly Residential Use in the Douglas Local Plan Order 1998, Map No. 2 (South). The site is not located within a Conservation Area.

The relevant planning policy from the Isle of Man Strategic Plan 2007 is General Policy 2.

The relevant planning policy from Planning Circular 1/98, The Alteration and Replacement of Windows, is General Policy 7 part i, which states;

Category c) BUILDINGS ERECTED BEFORE 1921 AND NOT FALLING WITHIN CATEGORIES a) OR b), WHICH HAVE LARGELY RETAINED THEIR ORIGINAL CHARACTER

7. For ease of use, this category has been divided into two, based on the location of the building:

i) Buildings in an Urban Setting

Policy

In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows. Windows not part of the principal elevations and which are not readily visible from a public thoroughfare should preferably have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in their construction.

CONSULTATIONS

## ASSESSMENT

The application site is not within a Conservation Area and nor is it a Registered Building. The application is proposing to install replacement casement windows and doors to the rear elevation and annexe in white upvc.

The proposed replacement doors would be on the inner side of the rear annexe. Two of the doors would be on the upper floors, leading to the external access stairs. The doors would replace existing and as such, it is considered that the impact would be minimal compared with the existing and would have no adverse effects.

In terms of policy 7 from Planning Circular 1/98, the proposed windows would be on the rear of the property. The policy therefore requires the windows to have "the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in their construction." The existing windows are sliding sashes and the frame sections have a 50/50 split with a single glazing bar running vertically through the upper and lower sashes. The proposed windows would be casements and the frame sections would have a 50/50 split with no inner glazing bars. Overall, it is considered that the appearance of the proposed windows would be similar to the existing as they would have the same frame sections. The exclusion of the vertical glazing bar would not significantly alter the appearance of the windows so as to warrant refusal.

RECOMMENDATION

For the above reasons, this proposal is considered to be acceptable and is recommended for approval.

## PARTY STATUS

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
