### Officer's Report

#### The Site

The application site represents the curtilage of an existing mid-terraced dwelling, 18 Melbourne Street, Douglas. The property has a modest Victorian style and is located on the eastern side of the road, opposite Park Road School.

#### The Proposal

Proposed is the installation of replacement windows to the front elevation.

The existing windows are painted timber casements. The proposed windows are white pvc-u casements.

There are 3 windows to the front elevation. The 2 first floor replacement windows would have the same frame sections and glazing bar pattern as the existing. The ground floor window opening is a larger size than the first floor windows. This replacement window would have a similar frame section and glazing bar pattern to the existing. However, the upper and lower sections of the window would be sub divided into three sections, rather than only the upper section being sub-divided into two sections at present.

#### Planning History

There are no previous planning applications for the application site.

## Development Plan Policies

The application site is located within an area designated as Predominantly Residential Use in the Douglas Local Plan Order 1998, Map No. 2 (South). The site is not located within a Conservation Area.

The relevant planning policy from the Isle of Man Strategic Plan 2007 is General Policy 2.

The relevant planning policy from Planning Circular 1/98, The Alteration and Replacement of Windows, is General Policy 7 part i, which states;

Category c) BUILDINGS ERECTED BEFORE 1921 AND NOT FALLING WITHIN CATEGORIES a) OR b), WHICH HAVE LARGELY RETAINED THEIR ORIGINAL CHARACTER

7. For ease of use, this category has been divided into two, based on the location of the building:

i) Buildings in an Urban Setting

Policy

In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows MUST HAVE the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows. Windows not part of the principal elevations and which are not readily visible from a public thoroughfare should preferably have the same or similar pattern of glazing bars as the originals, but not necessarily the original method of opening, whatever the material used in their construction.

## Assessment

The application site is not within a Conservation Area and nor is it a Registered Building. The application is proposing to install replacement casement windows to the front elevation in white upvc. Following previous officer visits to Melbourne Street, it has been established that there are a mixture of properties with casements or sliding sashes within the street. The material of the window frames also differs from timber to pvc. It is therefore considered that the proposed would not look out of place within the street scene and would have no adverse effects.

In terms of policy 7 from Planning Circular 1/98, the proposed windows would have the same method of opening and the same or similar frame sections and pattern of glazing bars as the existing windows. It is not known whether the existing windows are the originals, as the originals may have been sliding sashes. However, it is considered that the proposed windows would have a minimal impact on the character of the area as they would be similar to the existing.

## Recommendation

For the above reasons, this proposal is considered to be acceptable and is recommended for approval.

## Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
