### Officer's Report

#### The Site

The application site represents the curtilage of Anagh Coar School, Darragh Way, Anagh Coar, Douglas. The Primary School is located to the south west (rear) of Anagh Coar Stores and to the south of Cushag Road.

#### The Proposal

Proposed is the erection of a shelter in the school grounds. The shelter would be located on a grassy area in the eastern part of the site, near to a footpath (Darragh Way), which runs past the south east of the school grounds.

The proposed shelter is from a range designed by a company called Monster Play, who create playground and play equipment.

The shelter has a rectangular plan and both of the side walls slant outwards from the base, so that the length of the shelter increases from 3.1 metres to 4.67 metres. The width of the shelter is approximately 2.3 metres and the overall height is 2.5 metres.

The material used in the construction is galvanised steel, which would be powder coated. The shelter has built in speakers with radio and Bluetooth connectivity. There is also solar panel powered LED lighting.

## PLANNING HISTORY

The following previous planning applications are considered relevant in the assessment and determination of this application;

08/00154/B – Permitted 29.04.08 Erection of timber shed.

08/02297/B – Permitted 23.02.09 Erection of a shelter

## DEVELOPMENT PLAN POLICIES

The application site is located within an area designated as Buildings for Civic, Cultural and Other Special Use (Primary School) on the Douglas Local Plan Order 1998, Map No. 2 (South). The site is not within a Conservation Area.

The relevant planning policies from the Isle of Man Strategic Plan 2007 are General Policy 2 and Community Policy 5.

Community Policy 5 states:
"Permission will generally be given for proposals to improve or extend existing schools and institutions of higher education and to build new schools, subject to their being sited and designed in accordance with the other policies of this plan, having particular regard to the potential for community use of the buildings and the associated Open Space."

CONSULTATIONS

No written responses have been received from the Department of Infrastructure Highways Division or Douglas Corporation. REPRESENTATIONS No written responses have been received from the general public.

## ASSESSMENT

The proposed shelter would be located adjacent to a public footpath, which runs along the south-eastern boundary of the application site. The site is relatively open in character, so the shelter would be visible from the public footpath. The shelter would be modest in size and would respect the site and surroundings. Overall, I consider that the shelter will not adversely affect the visual amenities of the locality.

RECOMMENDATION

For the above reasons, this proposal is considered to be acceptable and is recommended for approval.

## PARTY STATUS

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered an "interested person" and as such should be afforded party status.
