## The Town And Country Planning Act 1999

### The Town And Country Planning (Development Procedure) Order 2005

TO: Mr Chris Heginbotham, Blair Athol, The Promenade, Port St Mary, IM9 5DB

In pursuance of his powers under the above Act and Order, the **DEPUTY MINISTER** for Infrastructure, following report by the appointed person, does hereby **REFUSE** the application by Mr Chris Heginbotham **Conversion of boarding house into 4 apartments at Lincluden, Glen View Terrace, Port Erin, IM9 6HA** for the following reasons:-

(i) The proposal would cause significant harm to the living conditions of the occupiers of the adjacent dwelling at 8 Glen View Terrace (Ridgewell) by virtue of noise, general disturbance and loss of privacy arising from the use of the proposed ramp and driveway, in conflict with an aim of part (g) of General Policy 2 of the Isle of Man Strategic Plan which seeks to protect the amenity of local residents.

(ii) The proposed apartments would not provide satisfactory living conditions for their future occupiers, due to the lack of adequate private outdoor amenity space provision, in conflict with the aims of Housing Policy 17 of the Isle of Man Strategic Plan.

(iii) The proposal makes inadequate provision for the parking of vehicles, and could as a result lead to the parking of vehicles in locations where road safety and the free flow of traffic would be jeopardised. Consequently, the proposal is in conflict with the parking standards specified in Appendix 7 of the Isle of Man Strategic Plan and with the aims of parts (h) and (i) of General Policy 2 of that Strategic Plan.
