### Officer's Report

#### The Site

The site is the residential curtilage of an existing dwelling situated on the eastern side of Station Road at its northern end, close to Four Roads roundabout. The dwellings is a semi-detached cottage, stone faced with vertically proportioned window apertures in the front elevation but with fixed lights and side hung casements. The property is a double-pitched cottage with the rear portion finished in render with squarer apertures. The property alongside has a single storey flat roofed annex on the rear of the property.

The rear elevation includes a door on the ground floor and a small window alongside.

The site backs onto open farmland and the side of the property faces north towards the roundabout separated therefrom by an electricity substation. View of the rear elevation is obscured by the properties on the southern side of the Castletown Road near the roundabout.

#### Planning Status

The site lies within an area designated on the Town and Country Planning (Development Plan) Order 1982 and draft Southern Area Plan as Residential.

## The Proposal

Proposed is the removal of the rear door and small window and their replacement with a pair of patio doors 1.8m wide.

Following concerns raised by the local authority and the neighbour, the proposal has been amended such that the new patio door opens inward and this has been circulated to all parties who have submitted views.

## Planning History

The property has been altered and extended under a number of previous applications, only one of which is relevant to the consideration of this application. PA 95/1355 was for an extension to the application property, refused on appeal for reasons relating to the blocking of a right of way from Holmcroft.

## Representations

Port St. Mary Commissioners indicate that the outward opening of the new doors may inhibit the right of way for the neighbour and suggest that the door should open inward.

The owner of Holmcroft objects to the application, stating that the doors should open inward so as not to obstruct her right of way and citing previous applications where proposals had been refused as they obstructed this.

Amended plans have been submitted responding to the above comments and these plans have been circulated. No further views have been submitted from either party in this respect.

## Assessment

The proposed alterations will not be visible and are no less appropriate on the rear elevation than are the existing door and window. There are no adverse impacts from the proposed alterations which are considered to accord with GP2. Now that the doors will open inward there will be no adverse impact on the neighbour in terms of rights of access.

## Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.

Holmcroft is immediately adjacent to the application site and as such should be afforded party status in this instance.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

### C 2.

This permission relates to the replacement of the existing window and door with patio doors as shown in drawings 1104/01, 1104/02 and 1104/03 received on 9th February, 2011 and 1104/04 Rev A received on 18th March, 2011. For clarification the new doors must open inward and not out over the right of way afforded to the occupants of Holmcroft.

I confirm that this decision accords with the appropriate Government Circular delegating functions to the Senior Planning Officer.
