## The Town and Country Planning (Development Procedure) Order 2005

### Schedule Of Conditions:

1. The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

2. This approval relates to the erection of a Northern EMI care unit with associated parking and landscaping as proposed in the submitted documents and drawings 2386.01.01, 2386.02.01, 2386.03.01, 2386.04.01, 2386.05.01, 2386.04.02 and 2386.04.06 all received on 18th March 2010.

3. No development shall take place until full details of hard landscaping works have been submitted to and approved in writing by the Planning Authority and these works shall be carried out as approved. Details of the hard landscaping works include footpaths and hard surfacing materials. The hard landscaping works shall be completed in full accordance with

the approved details prior to the first occupation of the EMI Unit. All planting shall be carried out in accordance the approved details in the first planting and seeding seasons following that first occupation. Any trees or shrub which within 5 years from the completion of the development dies, is removed or becomes seriously damaged or diseased shall be replaced in the next planting
4. The EMI Unit shall not be occupied until the highway adjacent to its western boundary and northwards up to and including the roundabout has been constructed in accordance with drawing no. 2386.02 .01 of approved application PA 10/00392/B, or in accordance with any subsequently approved access scheme, unless otherwise agreed in writing with the Planning Authority.

NOTE There are Underground Cables/Overhead Lines present in the area indicated in the planning application. The applicant is advised to contact the Network Operations Department, Manx Electricity Authority, (Tel. 687687) to discuss working practices around Cables and Overhead Lines which may be required to be diverted before any work can be carried out on site.

The applicant is also advised to contact the Manx Electricity Authority for Electrical Site Safety 5 documents, (Tel. 687766), before any work is carried out on site. All work to be carried out with reference to Health and Safety Executive Guidance Notes HS(G)47 \& GS6.

NOTE The proposed EMI unit must be connected to the foul sewer in a manner acceptable to the Isle of Man Water \& Sewerage Authority. All drainage works must conform to the requirements of the Authority's "Manx Sewers for Adoption" and all necessary inspections/ surveys [including CCTV] are to be carried out at the developer's expense.

In accordance with the Sewerage Act 1999, a communication fee will be payable to the Authority in respect of this development being connected (directly or indirectly) to the public drainage system.

Note: Under section 4(3) of the Sewerage Act 1999 the applicant must give 21 days notice, in writing, to the Authority, prior to making any communication to the public sewer. The applicant is therefore advised to contact the Development Control section of the Authority to discuss this matter.

NOTE There must be no discharge of surface water (directly or indirectly) from this proposed development to any foul drainage system(s) so as to comply with the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999.

It should be noted that it is an offence under Manx legislation to permit the discharge of pollution or harmful matter to any public sewers or watercourses. Appropriate measures must be taken by the developer/occupier of the premises to ensure compliance with the legislation.

NOTE The surface water discharges from the proposed development must be attenuated to a rate agreed with the Isle of Man Water \& Sewerage Authority to ensure that any existing downstream flooding is not increased.

NOTE Prior to the commencement of this proposed development, the applicant must supply foul discharge rates to the Authority in order to demonstrate that the pumping regime in the adjacent pump station does not require altering prior to occupation.

This decision was made by the Planning Committee constituted in accordance with Article 3(1) of the Town and Country Planning (Development Procedure) Order 2005.

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
