## Officer's Report

### The Site

The site is the curtilage of an existing dwelling situated on the promenade in Port Erin between Bay View Road and Maine Road. The property is a Victorian four storey double fronted property which has projecting bays alongside the front doors. The bays extend upward two floors then become narrower and extend upward into the roof, providing windows art eaves level under a pitched, slated roof. All windows within the buildings are vertically proportioned with a variety of windows, sliding sash, single lights and round headed sliding sashes, all timber framed. There is a small flat roofed dormer on one half of the property's front roof pitch.

All the properties in this block have plastic framed casement windows other than the Bay View building which has recently been renovated and which has sliding sash windows (07/01763/REM).

### Planning Status

The site lies within an area designated on the Port Erin Local Plan of 1990 as Tourism/Recreation. On the draft Southern Area Plan which was published on 23rd October, 2009 the site lies within an area designated as Residential.

### The Proposal

Proposed is the replacement of the existing windows with new plastic framed casement windows. Also proposed is the replacement of the front doors with plastic doors with central top lights. All windows are to have frames which match the shape of the aperture in which they are to be inserted.

## Planning Policies

The appropriate planning policy guidance is set out in Planning Circular 1/98 where it states: In an individual building, or group of buildings, whose principal elevations are readily visible from a public thoroughfare, if the original windows are in place, it may be possible to repair and renovate them. This can take place without permission, and will be encouraged by the Department. If repair is impracticable, or existing windows are not the originals, the preference will be for replacement windows in the said principal elevations to have the same method of opening as the originals. Whatever the material used in their construction, the windows must have the same or similar pattern and section of glazing bars and the same or similar frame sections as the original windows".

### Representations

Port Erin Commissioners indicate that they do not oppose the application.

### Assessment

The proposed Conservation Area shown in the draft Area Plan omits the buildings on the promenade but includes the land on the seaward side of the road. The existing windows are a mixture of sliding sash and fixed lights and the proposed windows will have the same pattern and section of glazing bars so the proposal complies with that part of the Planning Circular. Ideally the replacement windows should be sliding sash, regardless of material. However, the properties to the north have plastic framed casements permitted under PA 08/1631 (Regent) and PA 02/0382 (Gleneagles) after the introduction of the Circular.

### Party Status

The local authority is, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (d), considered an "interested person" and as such should be afforded party status.
