### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.
2. This approval relates to the demolition of existing dwelling and erection of a detached replacement dwelling, Ballacallin Cottage, Gordon, Patrick as shown by 0703/PL02 B and 0703/PL03 received 22nd October 2010.
3. The roof(s) must be finished in dark natural slate.

4. All windows, with the exception of those at lower ground floor level of the rear elevation shall be sliding sash.

5. Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2005 (or any Order revoking or re-enacting that Order) no extensions, greenhouses, walls, gates, fences, garden sheds, summerhouses, flag poles, decking, garages, or tanks for the storage of oil for domestic heating shall be erected (other than those expressly authorised by this approval).

6. All trees within or adjacent to the application site shall be retained and afforded adequate protection during construction works associated with this approval. No tree shall be cut down, uprooted or destroyed, nor shall any tree be topped or lopped without written approval of the Planning Authority. Any trees which are removed, or become seriously damaged or diseased must be replaced in the next planting season with others of similar size and species.

7. The existing Ballacallin Cottage must be demolished within one month of the occupancy of the new dwelling.

8. Prior to the commencement of the development there must be submitted to and approved by the Planning Authority a scheme of landscaping which shows how the area currently occupied by the new dwelling is to be landscaped. The approved landscaping scheme shall be implemented within the first planting season following the occupation of the new dwelling.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to her under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

**Guidance Note** This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005. Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

- Any appeal has been determined;

Whichever is the later.
