### Officer's Report

#### The Site

The application site represents the curtilage 6 Hailwood Court in Douglas. This property is situated off Johnny Wattersons Lane and adjacent to Cronk Y Berry Primary School, which is on the ground floor and is currently used as a carpet shop with apartments above.

#### Planning Status

The application site is located within an area of "Predominantly Residential Use" identified on the Douglas North Local Plan, 1998. Within the adopted Isle of Man Strategic Plan, the following policies are considered relevant:

Business Policy 10 which states that "Retail development will be permitted in established town and village centres, with the exceptions of neighbourhood shops in large residential area and those instances identified in Business Policy 5."

## Planning History

The application site has not been the subject of previous planning applications which is considered specifically relevant to the assessment of the current planning application.

## The Proposal

This application seeks approval for the change of use of this ground floor unit from a carpet shop to a betting shop, with no exterior alterations to the property needed.

## Representations

The Department of Transport Highways Division have not commented on the proposal.

The Douglas Corporation have Deferred until Public Works Committee has considered application on 15th October 2008.

Mrs Tatiana J Cojocaru of Hailwood Dental Practice, 4 Hailwood Court, Douglas has raised concerns over the safety and comfort of her customers, due to the customers from the betting shop smoking outside the premises which she feels would reflect badly on her business.

Mr Andy Cassidy of 5 Hailwood Court, Hailwood Avenue in Douglas has concerns about the late openings in the evening and with the customers of the betting shop congregating outside to smoke.

## Assessment

The development is situated within a predominately residential area on the Douglas Local Plan 1998, but adjoining to it are other local shops (i.e. Chemist, convenience store, takeaway). There are no specific policies which apply to the proposal, but the proposed application appears to respect the site and surroundings in terms of usage - as there will be no change in scale, form and design which would affect adversely the character of the surrounding landscape. This development will bring employment, investment and activity to this area which is encouraged.

Opening times would be between 10am to 6pm Monday to Saturday and 11am to 6pm Sunday (except for summer months for night racing 10am - 9pm), so noise would not be too much of a concern as this is within normal working hours of most businesses in surrounding area, with the Chinese takeaway and the Cat With No Tail Pub opening considerably later.

The issue that customers of the betting shop would congregate outside the shop to smoke is the main concern but this is not an issue the planning department can address and does not warrant enough for a refusal.

## Recommendation

For these reasons the proposal would be appropriate in this location.
