In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby APPROVE the following application made on behalf of:

which was considered on 23rd October 2008, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. This approval relates to the sale and storage of vehicles on land adjacent to the Old Brickworks, Mines Road, Foxdale as shown by the plans and information 1624/1, 1624/2 and Enforcement Photographs $\times 10$ submitted and date stamped 20th August 2008.
2. Within 28 days of the decision notice becoming final, a plan must be submitted and approved by the Planning Authority showing 5 dedicated visitor parking spaces. These must be clearly marked as being reserved for customers visiting the site and retained for this use only. It is recommended that the applicant consults with The Department of Transport Highways Division in relation to this issue.
3. There must be NO discharge of surface water (including that from roofs and paved areas) from this proposed development to any foul drainage system(s) so as to comply with

the requirements of the Department of Transport Drainage Division and the Sewerage Act 1999.

NOTE It should be noted that it is an offence under Manx legislation to permit the discharge of polluting or harmful matter to any public sewers or watercourses. Appropriate measures must be taken by the developer / occupier of the premises to ensure compliance with the legislation.

This decision was made by the Senior Planning Officer in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005.

## Guidance Note

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
