### Officer's Report

The application is seeking permission to enlarge the one of the commercial units and to use it as an office. This will result in the loss of 2 previously approved apartments to enable the expansion to be accommodated. I consider the proposal to be acceptable considering the site is being developed for a combination of commercial/residential uses. The net floor space will be 278 sq m which will require 6 parking spaces. The application allocated 3 spaces in the basement and 3 in an existing nearby car park on the south quay; however, the plans do not show any detail of the South Quay car parking. This detail could be required by conditions.

The Department of Agriculture, Fisheries and Forestry have commented that "During construction works every effort must be made to safeguard against water pollution to the nearby watercourse

from any surfacae run off and sedimentation." The works will not affect watercourse as this are internal alterations to the development.

The notes suggested by consultees are not material planning considerations and for that reason are not attached to the report, as part of the recommendation.

I therefore recommend that planning permission be granted subject to conditions.

## Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The comments from the Isle of Man Fire and Rescue Service are not a material consideration and should not be afforded party status in this instance.

The Department of Agriculture, Fisheries and Forestry do not have sufficient interest in this application particularly as the works are internal alteration to the scheme and therefore should not be afforded party status in this instance.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to alterations to create an office unit as shown in drawing numbers Sk01 and Sk02 date stamped 17th June 2008.

C 3. The proposed commercial unit, marked as Commercial Area 2 on the approved plans, may be used for any purposes within Class 4 ("Offices") of Schedule 4 to the Town and Country Planning (Permitted Development) Order 2005; any other use must form the subject of a separate planning application.

C 4. Prior to the first use of the unit, details of the allocated parking spaces within the car park on the South Quay, as indicated on the approved plans, shall have been submitted to and approved in writing by the planning authority and thereafter those spaces shall remain available for that purpose.
