### Officer's Report

#### The Site

The site represents part of a farm holding situated to the east of the Ballamodha Straight (A3) and to the north of the Bayrauyr (B30). The site accommodates a group of farm buildings close to the rear of the Ballamodha Straight and a developing farmhouse and farm building further to the east, served by a new access which is in place.

#### Planning Status

The site lies within a area of "white land" on the Isle of Man Planning Scheme (Development Plan) Order 1982, that is, not designated for development.

## Planning History

Planning permission in principle was granted for the new agricultural dwelling and building under PA 05/0512 and the reserved matters permitted under PA 06/1342. This was amended under PA 07/0985 which proposed a two storey rear annex in place of the permitted single storey annex.

### The Proposal

Now proposed are further amendments in the form of:
the increase in size of the sun room and removal of stonework from the walling relocation of the door in the front porch to the side removal of the window in the rear elevation alongside the rear door removed relocation of the bathroom window to the opposite elevation internal re-arrangements which are not subject to planning control the installation of three rooflights in the front pitch and provision of stair access to the attic.

### Representations

Isle of Man Water Authority recommend consultation regarding the provision of water so the development, which is not a planning matter and not relevant to the planning decision notice.

The Isle of Man Fire and Rescue Service recommends consultation regarding the internal layout which is a matter for the Building Regulations and should not be referred to in the planning decision notice.

Malew Parish Commissioners indicate that they have no objection to the proposal.

### Assessment

The proposed changes are largely cosmetic and do not materially change the appearance of the property which is some distance from the public highway. The omission of the stonework is disappointing but will not be appreciated as the elevations which are affected do not face the highway. As such it is considered that the proposed alterations are acceptable.

As the proposal is for the erection of a dwelling which is larger than that permitted under the original permission, PA 06/1342, it is appropriate to suspend the provisions of the Town and Country Planning (Permitted Development) Order 2005 to control any further extension of the property.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Isle of Man Fire and Rescue Service and Isle of Man Water Authority raise issues which are not relevant planning considerations and as such should not be afforded party status in this instance.

### C 1.

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

### C 2.

This permission relates to the erection of an agricultural worker's dwelling as shown in drawings HLK/06/0144/2c, -/3a, -4a, HLK/08/0097/1 and HLK/06/0144/5 all received on 12th May, 2008.

### C 3.

The occupation of the proposed dwelling must be limited to persons whose employment or latest employment is or was solely in agriculture in the Island and includes the dependants of such persons.

### C 4.

Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 2005 or any Order superseding this, no further extension of the property may be undertaken without the benefit of planning permission.
