### Officer's Report

#### The Site

The site represents the residential curtilage of an existing property situated at the south eastern corner of a relatively recent development of dwellings situated on the eastern side of Church Road. The development comprises semi-detached two storey houses, terraced houses and detached bungalows.

The application site accommodates a semi-detached two storey property with car parking alongside the dwelling. The property is finished in brick and with concrete tiled roof.

#### Planning Status

The site lies within an area designated on the Laxey and Lonan Local Plan of 2005 as Proposed Residential as the site was not developed at the time of adoption of the Plan.

#### Planning History

No development has been proposed in respect of this property since the development of the estate under PA 00/1342.

## The Proposal

Proposed is the extension of the property, providing a two storey extension with a ridge line matching that of the existing dwelling and a pitched roof front feature which projects forward of the existing front wall of the house by 0.3m. The rear wall of the extension will be in line with and the same height as the existing rear wall and roofing.

Also proposed is the erection of a retaining wall up to 1500mm (the annotation suggests it will be 1800mm high) above ground level which will supplement and be built inside an existing fence: the walling will have a new fence atop 1100mm high. Backfilling of the bottom end of the garden is proposed to create a level area. The new fence top will be up to higher than the existing fence on the rear boundary. The level of the rear garden will be increased by up to 1.4m with an 1100mm fence surrounding the new "patio".

The applicant has confirmed that the wall will be up to 1.8m in places but will slope according to the ground. He also confirms that they cannot see any part of Santos from their property at present and are unlikely to from the raised platform. The applicant also confirmed that he considered an extension to match that which the neighbouring property has permission for but this affords less space than would the scheme which is proposed here. He pointed out that there are projecting gable features elsewhere close by, in Church Close and that there are larger properties, which are proposed on the land to the north in the extension to the development (PA 07/2153 – permitted).

## Representations

Department of Transport Highways and Traffic Division do not oppose the application provided that 2 parking spaces are provided off street. There are four car parking spaces available in front of the extended dwelling.

Lonan Parish Commissioners object to the application on the basis that they are opposed to such "large scale extensions" which cumulatively will lead to larger buildings which are out of keeping with the streetscene and suggest that continued approvals for this scale of extension "exposes inconsistencies with the Isle of Man Planning Department policies" although the Commissioners do not expand upon which policies are being contradicted.

The Fire Prevention Officer requests the installation of smoke detection which is dealt with as part of the Building Regulations and as such is not a planning matter and should not be referred to in the planning decision notice.

## Assessment

The adjoining property has had permission for a two storey extension under PA 07/0023 although this extension is set back slightly from the front face of the existing house and the ridge line is slightly lower. It may have been preferable to mirror this rather than having a completely different style of extension. However, as is pointed out by the applicant, there are a variety of house styles and sizes proposed on the adjacent land and not all of these properties are symmetrical and types E, F and G have projecting gables and a staggered frontage.

Permission has also been granted for the erection of decking immediately to the rear of a number of properties further to the south where such decking would result in a much more prominent impact and more significant overlooking the properties to the south which are not screened as much as is Santos.

As such the proposal is considered acceptable.

## Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.

The Fire Prevention Officer requests the installation of smoke detection which is dealt with as part of the Building Regulations and as such is not a planning matter. The Fire Prevention Officer should not be afforded party status in this instance.
