## SECTION 16 (FORM PA1.4) - CONTINUATION SHEET (1 of 2)

**RECEIVED ON** **PROPOSED ERECTION OF A FENCE AT** **28 BOWLING GREEN ROAD, CASTLETOWN** **- 7 JAN 2008**

The purpose of the proposed new fence is to provide some privacy for the applicant and his family when using the garden at the rear of the property at 28 Bowling Green Road (the "Property").

As can be seen from the appended diagrams and photographs, Crown Place (a property of that name situated on Shore Road, Castletown ("Crown Place")) and adjoining the rear boundary of the Property has a raised concrete pathway (the "Pathway") connecting the off-road parking area situated at the front of Crown Place (with access on to Shore Road) with the garden at the rear of Crown Place. The Pathway enables the inhabitants of Crown Place to (i) access their house through a door leading into a first floor kitchen (which can be seen on Photo A and Photo C appended hereto) and (ii) to access the back garden of Crown Place. (Document A highlights the location of the Pathway.)

The height of the partition wall (between the Property and Crown Place where the applicant would like to erect the fence) is, for a large section, only 1.25 meters (approx.) on the Crown Place side of the wall. This means that the inhabitants of Crown Place are very visible (from the rear garden of the Property) when using the Pathway (which is heavily used in the summer) and means that the garden at the rear of the Property is very easily overlooked.

The proposed new fence (details of which are set out in Document C appended hereto), which would be erected on the Property's side of the boundary wall between the Property and Crown Place, will increase the height of the wall/fence on the Crown Place side to 2 meters (where the height of the partition wall is currently 1.25 meters (approx.) on the Crown Place side).

The proposed new fence will be constructed in wood and will be in the "shadow box" style (please see Document D which sets out a diagram of the shadow box style of fencing) which will mean that (i) it will look attractive from both sides of the fence and (ii) any breeze/wind will easily pass through it. The design features of the fence will be as follows:

(a) **Posts**

4 inch wide/thick posts which will be attached to the side of the boundary wall (on the 28 Bowling Green Road side). Each post will have a flat topping and will taper in towards the wall at the bottom of the post.

(b) **Boards**

6 inch wide and 1 inch thick boards with rounded tops.

(c) **Rails**

4 inch wide, 2 inch thick, rails to be used.

### Proposed Erection Of A Fence At 28 Bowling Green Road, Castletown

The applicant believes:
(a) that the design and appearance of the proposed new fence (which will be stained a dark colour) will complement its surroundings;
(b) as there are no windows in the Crown Place property that would be affected by the proposed new fence, the fence will have no detrimental impact on Crown Place; and
(c) the proposed new fence will provide some much needed privacy to the rear garden at the Property.
