# Refusal Notice 06/01633/B

## Town and Country Planning Act 1999

### Town and Country (Development Procedure) Order 2005

Mr C B Mallor
29 Kensington Road
Douglas
Isle Of Man

In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **REFUSE** the following application made on behalf of:

**Name:** Mr C B Mallor
**Proposal:** Removal of cornice to front elevation and replacement of existing render
**at:** 76 Allan Street
Douglas
Isle Of Man
IM1 3DR

which was considered on 28 November 2006, for the **reasons** set out below.

**Date of Issue:** 29 November, 2006
**Murray House Mount Havelock Douglas**
**Secretary Planning Committee**
*(Signature)*

### Reasons For Refusal:

1. The removal of the cornice would result in the loss of an architectural feature from which has some merit to the property and the street scene. The removal of the cornice would affect the character and appearance of the street scene to the detriment of the visual amenities of the locality.

Furthermore, the removal of the cornice would result in substantial structural work which may require planning permission and the application does not contain this detail to assess accurately the impact on the character and appearance of the street scene.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005
