### Officer's Report

#### The Site

The site defined in red represents a presently vacant site (but under development) which sits on the corner of Farrant's Way and Scarlett Road. Also defined in blue is a parcel of land on the eastern side of Scarlett Road which has planning permission for the erection of seven dwellings with garden areas and car parking (PA 03/0521). This land is also in the ownership of the applicant.

#### Planning Status

The site lies within an area designated on the Castletown Local Plan as Predominantly Residential. The draft Castletown Area Plan (which was abandoned prior to the holding of a public inquiry) identifies the site as Proposed Residential.

#### Planning History

There have been various proposals for the residential development of this site. PA 03/0520 proposed the erection of a block of 54 apartments and public car parking and was permitted on appeal PA 03/1816 proposed erection of 38 apartments and associated public and private parking and was refused

PA 04/0944 proposed the erection of a 38 apartments block and associated public and private parking and was refused on review and PA 04/2283 proposed the erection of a 38 apartment block with associated public and private parking and was permitted on appeal.

### The Proposal

Proposed now are amendments to the scheme permitted under PA 03/0520. The alterations concern windows in the rear elevation. The permitted windows had a solid central panel with slim side lights. Proposed is the replacement of these with, in the peaked roofed dormer, solid side panels and a top hung casement above a fixed lower light, matching the window pattern on the front elevation. The illustration shows half the building - there are three more windows exactly the same in the other half of the building which are to replaced also, making six windows in total - four which will have a solid outer frame and casements installed in the centre and the other two which will be solid panels within the aperture.

### Assessment

The change will bring the rear of the building in line, visually with the front and the changes are largely ones which will improve the appearance of the building.

### Party Status

The Department of Transport and the local authority are, by virtue of the Town and Country Planning (Development Procedure) Order 2005, paragraph 6 (5) (c) and (d), considered "interested persons" and as such should be afforded party status.
