## THE APPLICATION SITE AND PROPOSED DEVELOPMENT

The application site comprises the curtilage of a mid-terrace dwelling located on Summerhill Road in Onchan.

The proposed development comprises of alterations and extensions to the dwelling to create a single storey extension onto the rear elevation of the dwelling.

## PLANNING HISTORY

The application site has been the subject of one previous planning application in recent years:

Planning application 05/01362/B sought approval for the erection of a roof terrace/garden. This previous planning application was initially considered and refused on the 23rd September 2005, with the initial refusal decision notice issued on the 3rd October 2005. The Planning Committee resolved to confirm the refusal at review on the 18th November 2005, with the review refusal decision notice issued on the 23rd November 2005. A subsequent appeal against the refusal was dismissed by the Minister, in agreement with the appointed Planning Inspector, on the 28th February 2006.

REPRESENTATIONS Onchan District Commissioners recommend that the planning application be approved. PLANNING POLICY

The application site is within an area recognised as being within predominantly residential use under the Onchan Local Plan. Policy O/RES/P/21 of the written statement (Planning Circular 1/2000) that accompanies the Onchan Local Plan states:

"Extensions and alterations to existing residential property will generally not be opposed where such proposals are appropriate in terms of scale, massing, design, appearance and impact on adjacent property."

## ASSESSMENT

The development proposed by this planning application is materially different in form to the one previously refused. It does not include any terracing element and therefore does give rise to the previous concerns regarding overlooking and loss of privacy.

In terms of what is proposed it is considered that the overall level of development contained within the proposal is relatively modest and in keeping with the character of the dwelling. As such it concluded that the proposal does not adversely affect public or private amenity and, as such, is in accordance with policy O/RES/P/21 of the Onchan Local Plan.

I recommend that the planning application be approved.
