### Officer's Report

The application site represents an area to the east of the A27 and to the north of Gordon Lane, Gordon, Peel. The site is a grassed area with a 'former dwelling' indicated on the site plan but there is no evidence on site of such a dwelling.

### Planning Status

The site is located in an area zoned as being of High Landscape Value and Scenic Significance and is not zoned for residential development in the 1982 Development Plan Order.

### Representations

Representations have been received from the Department of Transport Highways Division, who object to the development on highway/access grounds and the SPMCE who also object to the proposal. A resident of Port Soderick objects to the proposal and Patrick Commissioners raise no objection but advise that any dwelling must conform to Planning Circular 3/91.

### Site History

The following previous application is considered to be relevant to this application:

PA 01/02105 – Approval in principle for erection of dwelling, land to the rear of Jamf, Gordon Lane, Patrick. Refused initially 14th February 2002, refused at Review 12th April 2002.

### The Proposal

The application seeks approval in principle for the construction of a single detached property.

### Assessment

The application proposes the construction of a dwelling on land not currently zoned for residential development and within an area zoned as Area of High Landscape Value and Scenic Significance. The construction of a dwelling in this location, for which no justification has been submitted, is considered to be contrary to the well established policies of the Department and represent a sporadic and unsustainable form of development in the countryside. This view is confirmed by the refusal of a previous application (PA01/02015 refers), and it is not considered that circumstances have changed since that decision.

Furthermore, the Department of Transport objects to the development on the grounds that there is insufficient visibility at the junction of Gordon Lane and the A27, to serve the needs of the development.

### Party Status

It is considered that all parties who made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status with the exception of the following:

Mr A Jessop, Seacliffe, Old Castletown Road, Port Soderick.

R 1. The site is not zoned in the 1982 Development Plan Order for residential development and falls within an area of countryside designated as having High Landscape Value and Scenic Significance. There are no exceptional circumstances to allow a new dwelling on this site, which would be contrary to established planning policies in respect of development in the countryside and represent sporadic unsustainable development.

R 2. The visibility at the junction of the A27 and Gordon Lane is considered to be insufficient to serve the additional traffic a development of this nature would generate.
