Dear Sirs

Re: PA06/01078/D - Erection of site sales signage, at proposed residential development, Former St Ninians Church Hall, St Ninians Road, Douglas

I am writing with regard to the above planning application, which was refused by the Director of Planning and Building Control by the authority delegated to him by the Department under the Town and Country Planning (Development Procedure) Order 2005.

As the signage is already in place, you are advised that this signage is to be removed within 28 days of the date on which this decision becomes final.

Yours sincerely,

Mrs Cath Dudley,
Deputy Secretary, Planning Committee.

## Town and Country Planning Act 1999

### Town and Country (Development Procedure) Order 2005

Cornerstone Architects
79 Parliament Street
Ramsey
IM8 1AQ

In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **REFUSE** the following application made on behalf of:

**Name:** Hartford Homes Ltd
**Proposal:** Erection of site sales signage, at proposed residential development
at: Former St Ninians Church Hall
St Ninians Road
Douglas
Isle Of Man
IM2 4BE

which was considered on 8 December 2006, for the reasons set out below.

**Date of Issue:** 26 December, 2006

Murray House Mount Havelock Douglas
Secretary Planning Committee

### Reasons For Refusal:

1. The signage located at the southwest corner of the site is close to the pedestrian crossing used to access the school. The signage in this location has the potential to distract motorists; as such it would be detrimental to road safety.

NOTE 1. As the signage has been erected and the retrospective application been refused, within 28 days of the date of this notice as it becomes final, the signage must be removed and the site made good.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005

The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

A form and guidance notes are available from either the Planning Office, Tel 685950, or to down load from the Department's website www.gov.im/dlge/planning/plan

You should note that a copy of the Officer's report which led to the decision being made, along with any correspondence relative to the application, is available for inspection at the Department.
