In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 22 June 2006, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This approval relates to the submitted documents and drawings 5296/1, 5296/2, 5296/4 and 9296/5 all received on 15th March 2006.

3. The car parking spaces shown on drawing 5296/3 may only be used by the occupiers of the proposed residential unit and workshop and specifically car parking space number two must be kept available at all times for the occupants of the proposed residential unit.

4. Prior to the first occupation of the proposed residential unit the boat and trailer on the parking area must be removed.

5. The proposed development must be connected to the main foul sewer.

NOTE: A Drainage Connection Fee will be payable to the Drainage Authority on this development; the developer’s attention is drawn to the written comments from the Drainage Services Manager, a copy of which is attached hereto.

6. The proposed dwelling may be occupied only by the operator and family of the ground-floor workshop.

NOTE The Isle of Man Fire Department have recommended a refusal as, the escape from the second floor bedroom is via a staircase which discharges into an open plan lounge/kitchen which is inherently unsafe in the event of fire, and escape from the entire proposal is via a staircase which is next to a window in the workshop and may be un-passable in the event of a fire in the workshop breaking out of the said window. The applicant is advised to consult the Fire Safety Department to discuss the fire precautions.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005

This permission refers only to that required under the Town and Country Planning (Development Procedure) Order 2005.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.

You should note that a copy of the Officer’s report which led to the decision being made, along with any correspondence relative to the application, is available for inspection at the Department.

The proposed development must not be commenced until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.
