### Officer's Report

## 1. THE APPLICATION SITE AND PROPOSED DEVELOPMENT

1.1 The application site comprises the curtilage of detached dwelling that is located at the northern end of Mines Road in Laxey.

1.2 The proposed development comprises of the alteration and extension of the dwelling by means of an increase in its height and an extension to the rear.

## 2. PLANNING HISTORY

2.1 The application site has not been the subject of any previous planning applications that I consider relevant to the assessment of this current planning application.

## 3. REPRESENTATIONS

3.1 Laxey Village Commissioners have no objections to the proposed development.

3.2 The Department of Transport Highways Division object to the proposed development on the grounds that they consider the parking and access arrangements inadequate to serve the needs of an extended property.

3.3 The Department of Transport Drainage Division have no objections to the proposed development subject to the imposition of conditions.

3.4 The Isle of Man Fire and Rescue Service make no comment on the merits of the proposed development but recommend that smoke detectors are installed.

### 4.0 Planning Policy

4.1 The application site is within an area recognised as being in predominantly residential use under the Laxey and Lonan Area Plan.

4.2 The application site is within the Laxey Conservation Area.

### 5.0 Assessment

5.1 There are no policies within the Laxey and Lonan Area Plan that I consider to be specifically relevant to the assessment of this planning application.

5.2 In terms of examining the proposed development I consider the key issues to be an assessment of the impact on public amenity, private amenity and highway safety.

5.3 With regards to the impact on public amenity I am satisfied that the resultant form of the proposed development is suitably in keeping with the visual character of the area and generally acceptable. The proposed alterations and extensions are appropriate for the location of the application site within a Conservation Area.

5.4 With regards to the impact on private amenity I am satisfied that the proposed development will not adversely affect the residential amenity of the neighbouring properties.

5.5 With regards to the impact on highway safety and specifically the objection from the Highways Division I am satisfied that the level of alteration and extension will not result in significant changes to the existing situation. The proposed development changes a two bedroom property into a three bedroom property and, based on my site visit and subsequent information from the applicant’s agent, I consider that it would be unreasonable to refuse the application solely on the basis of the objection.

5.6 I consider the proposed development to be acceptable and recommend that the planning application be approved.

### 6.0 Party Status

6.1 I consider that all parties that made representations to the planning application meet the criteria of Government Circular 1/06 and should be afforded interested party status.
