In pursuance of powers granted under the above Act and Order the Department of Local Government and the Environment does hereby **REFUSE** the following application made on behalf of:

Isle Of Man

which was considered on 4 July 2006, for the reasons set out below.

### Reasons For Refusal:

1. The proposed new dwelling would be located in an Area of High Landscape Value and Scenic Significance and outside an area currently zoned for residential development in the 1982 Development Plan Order. As such, the application is considered to be contrary to the established policies of the Department with regard to new dwellings in the countryside.

2. Notwithstanding the information submitted with the application relating to agricultural need, it is considered that application is contrary to the provisions of Planning circular 1/88 and 3/88 in relation to new dwellings in the countryside, insofar as it has not been demonstrated that the occupation of the occupier of the proposed dwelling would relate to agriculture on a full time or retired basis. Furthermore, the siting of the dwelling is considered to be contrary to the requirements of Planning Circular 3/88, in terms of the distance from the main farm.

This decision was made by the Director of Planning and Building control in accordance with the authority delegated to him under Article 3(13) of the Town and Country (Development Procedure) Order 2005

The decision contained in this notice does not become final until either;
- The time for requesting an appeal has expired; or
- Any appeal has been determined;

Whichever is the later.

Any appeal against this decision must be in writing and must be received by this Department within 21 days of the date of this notice.
