#### Proposal / Site

The application proposes the change of use of former medical osteopath premises to a retail unit at unit 8, Clinches Court, North Quay, Douglas. The property is part of a row of two storey terraced properties which have been zoned under the Douglas Local Plan Order 1998 as an area of mixed used development in the Town Centre and also within a Conservation Area.

The existing unit is currently used as a medical osteopath and the proposed change of use is to a retail unit to sell sweets and confectionary. The applicant proposes minor internal alterations by adding counters, shelving and a small central display area / stand. The submitted application does state that the façade of the shop will be painted in keeping with the surroundings, however to change the external appearance of the property a new application would need to be submitted.

### Relevant Planning History

The Property has had benefited from a recent Planning Approval for the Change of use from retail to osteopathic treatment centre (02/01266/C).

### Consultations

The Public Works Committee of Douglas Corporation and the Department of Transport have both considered the application and neither have raised an objection.

We have received no privately written representations objecting to the application.

### Assessment / Recommendation

The site which was previous an retail unit prior the change of use to it present use is situated in an area of mixed use developments ranging from hairdressers, tanning salon, restaurants, pubs and news agencies. As the site was once a retail unit and is within an area zoned for mixture use in the Douglas Local Plan the proposal would seem to be acceptable in this location and therefore my recommendation is for an approval.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to the submitted documents, and shown in drawings A1, A3 and A4 all received on 17th November 2005.

N 1. Any alterations to the exterior of the building (including the display of signage) must form the subject of a separate Application to the Department. However if the façade of the shop is only going to be painted no Planning Application would be required.

I confirm that this decision accords with Government Circular Nos 44/05 (Delegation of Functions to Director of Planning and Building Control) and 47/05 (Delegation of Functions to Senior Planning Officer)
