### Officer's Report

The application site is a two storey semi detached house situated on the southern side of the Main Road (A3), Ballaugh. The site is located within a predominantly residential area.

The proposal is to erect a conservatory to the rear of the application site. The proposal is to be sited on the southern side of the property. The proposal will project 3.2m to the rear of the application site.

The occupiers of Eary Veg have objected to the proposal on the grounds that it will block out light to the kitchen and obscure the view to the rear. The objectors has commented that the property already has one extension to the property and the one now proposed will make both extension bigger than the original property. Access for the building work will be through the garden.

In respect of the impact on Eary Veg, the application site is set to the north east of the neighbouring property. The nearest habitable window is set approximately 1.5m away from the side elevation of the conservatory. The proposal contains a full height window in the side elevation. The applicant has indicated the window will be obscure glass. I therefore consider the proposal will not cause any significant harm to the occupiers of Eary Veg from overlooking or overshadowing.

In respect of the impact on Chestnut, the application site is set to the south west. There are no habitable windows in the side elevation of the neighbouring property. I there proposal is set off a significant distance from the boundary. I consider the proposal will not cause any significant harm to the occupiers of Chestnut from overlooking or overshadowing.

The proposal is set to the rear of the property. It will not be visible from the public highway. I consider the proposal will not impact on the visual amenities of the locality.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This permission relates to the erection of a rear conservatory as shown in drawing numbers; 2054/1; 2054/2 and 2054/3 date stamped 26th October 2005

C 3. The window in the south west facing elevation of the conservatory shall only be obscure glazed.

C 4. The facing material of the conservatory must match those of the existing building in all respects.
