In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

### Schedule Of Conditions:

1. This approval is in principle only and will remain valid for a period of two years within which time no development may take place until such time as details of the reserved matters (siting, design, external appearance, internal layout, means of access, landscaping) have been approved by the Planning Authority. Such reserved matters should form the subject of a single application.

2. The occupation of the proposed dwelling(s) must be limited to persons whose employment or latest employment is or was employed in agriculture in the Island and including also the dependants of such persons as aforesaid.

3. This permission relates to the principle of the erection of two agricultural dwellings in the location shown in drawings 843-01 and -02 both received on 31st October 2005.

4. Each dwelling must be different in appearance to the other and sited and accessed from the Orrisdale road as shown in the approved drawings. Both dwellings must be designed in accordance with policies 2-7 inclusive of Planning Circular 3/91 – Guide to the Design of New Residential Development in the Countryside.

5. The application for reserved matters must demonstrate that both of the new dwellings have a safe means of access onto the Orrisdale Road and afford parking and turning space for at least two vehicles. The access should provide visibility splays of 2.4m by 120m.

This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.

Note 3: Rights of the appeal against the decision of the planning committee are attached.

Note 4: An appeal must be requested within a period of 21 days.

### Reasons For Refusal:

1. There is insufficient evidence to demonstrate that there is, at this time need for an additional two agricultural dwellings on the farms.

2. The siting of the proposed dwellings is such as to extend the ribbon of built development along the north side of the Orrisdale Road.

**NOTE** This decision is without prejudice to an application which demonstrates that there is at this time need for two additional dwellings, and which demonstrates that the

dwelling or dwellings could not be accommodated on the other side of the road to the south-east of the farm buildings.

NOTE This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.

- the time for requesting a review of the initial decision has expired; or
- any review of the initial decision has been completed; or
- the time for requesting an appeal in relation to any decision at review has expired; or
