In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

### Schedule Of Conditions:

1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

2. This permission relates to the erection of a clubhouse with associated toilet, store, office and administration facilities together with a kart racing track as shown on drawing numbers 5026/1; 5026/2 and 5026/3 date stamped 4th March 2005.

3. Prior to the erection of the building, samples of the proposed facing and roofing materials to be used (including details of the colour finishes to be used in

construction of the external surfaces of the building) must be submitted to and approved in writing by the Planning Authority. Once approved the development shall be carried out only in full accordance with such approved details or any approved amendments.

4. Prior to the building becoming operational, a disabled access ramp into the building must be provided in full accordance with details to be submitted and approved in writing by the Planning Authority; thereafter no alterations shall be made to the access ramp without the prior written approval of the Planning Authority.

5. Within six months of the first use of the building, trees and shrubs shall be planted in accordance with a scheme which has been submitted to and approved in writing by the Planning Authority. Any trees or shrubs removed, dying, being severely damaged or becoming seriously diseased within five years of planting shall be replaced as soon as practicable by trees or shrubs of similar size and species to those originally required to be planted.

6. The floodlights shall only be operated between the hours of 8.00am and 9.30pm. The only exception will be in connection with the 1x 24 hour event per annum.

7. No development should take place between 1st March and 31st July to protect ground-nesting birds.

8. Prior to the erection of the fencing, details of the fencing (including details of the colour coating) required as part of the development hereby approved must be submitted to and approved in writing by the Planning Authority. Within one month of the erection of the fencing it shall be colour coated in accordance with the approved details.

9. No noise from the vehicles on the kart track shall be clearly audible at any residential property and/or within the prison wall outside 0900-2100 hours, with the exception of condition 10 below.

10. The specific noise source level emitted from the kart track, shall not exceed LAeq, 1 hour - 55 db daytime (0900-2300 and LAeq, 1 hour - 45 db night-time (2300-0900) measured at any residential property and/or within the prison wall at positions which are outside any buildings where people could be affected for more than 1 event per annum.

11. The specific noise source level emitted from the kart track, shall not exceed LAeq, 1 hour - 55db daytime (0900-1800) measured at any residential property and/or within the prison wall at positions which are outside any buildings where people could be affected for more than 2 daily events per month.

12. The rating level of noise emitted from the kart racing track, other than specified in conditions 10 and 11 above, shall not exceed LAeq, 1 hour - 37 db between 0900-1800 hours measured at any residential property and/or within the prison wall at positions which are outside any buildings where people could be affected.

13. The rating level of noise emitted from the kart racing track, other than specified in conditions 10 and 11 above, shall not exceed LAeq, 1 hour - 32 db between 1800-2100 measured at any residential property and/or within the prison wall at positions which are outside any buildings where people could be affected.

14. Prior to the commencement of works, further details of any external floodlighting scheme (including details of the height of the floodlights, colour coating of columns, directional control and spillage of light) required as part of the development hereby approved must be submitted to and approved in writing by the Planning Authority. The Planning Authority will need to be satisfied that the lighting scheme proposed is the minimum required for working purposes and that it minimises potential pollution from glow and spillage.

15. The Kart Track shall only be used between the hours of 0900 - 2100 except for 1 x 24 hour event per annum.

NOTE PRIOR to the commencement of any works, the developer must consult with the Fire Prevention Officer with regard to the fire precautions contained within the proposed building.

NOTE Noise level assessments shall be made in accordance with BS 4142:1997 'Method for rating industrial noise affecting mixed residential and industrial areas' and made outside buildings at least 3.5m from any reflecting surface other than the ground, that will give results that are representative of specific noise level and background noise level where people are likely to be affected.

NOTE For water connections that comprise more than a single connection to a water main or service, or where new water mains and hydrants will be required, the applicant should contact the Isle of Man Water Authority Planning and Projects Section, telephone 695958.

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -
- the time for requesting a review of the initial decision has expired; or
- any review of the initial decision has been completed; or
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.
