The site relates to Laurel View Farm, Laurel Bank, St Johns. The land is between the Starvey Road and the TT Course at Laurel Bank.

#### Planning History

**PA 00/517/B Erection of agricultural building field 2267 Laurel View**
Laurel Bank, St. Johns – Refused at Appeal. The Inspector judged there was a need but the site was visually prominent.

**PA 01/00980/B Erection of agricultural building Field 2306, Laurel Bank**
St. Johns – Approved – expires on 11th October 2005.

The applicants have not erected the building that permission was granted for under PA 01/980. Instead the applicants have erected a makeshift agricultural building alongside the Vaaish Plantation. The Enforcement Officer requested a retrospective application.

After having had a meeting with the applicant, the reason for erecting the building was down to cost. It is seen as a temporary measure until funds are available to build the building as approved.

The temporary building is located in the field next to the one where a building was refused at Appeal, under PA 00/517.

Whilst I am concerned about the siting of the building because of the previous appeal decision (this is an area of High Landscape Value), I do not doubt the financial constraints set out by the applicant. They are currently renovating a house at Lhergydhoo and Mr and Mrs Dunn have had two children in as many years.

I suggest that temporary approval is given for the building with the following condition:

"This approval relates to the erection of an agricultural building as detailed on the drawings submitted on 10th March 2005. The building shall be removed in its entirety from the site and the ground reinstated to its former condition within 2 years of the date that this decision becomes final or within 8 weeks of the completion of the building approved under PA 01/0980, whichever is the sooner."

Note: Planning approval for PA 01/0980 will lapse on 11th October 2005.

A further retrospective application is shortly to be considered for roadways which have been constructed on the farm.

The building shall be removed in its entirety from the site and the ground reinstated to its former condition within 2 years of the date that this decision becomes final or within 8 weeks of the completion of the building approved under PA 01/0980, whichever is the sooner.
