### Officer's Report

The site relates to Ballig Farm, which is north of Ballacraine Crossroads, St Johns.

#### Planning History

PA 03/0057 Approval in principle for the erection of an agricultural dwelling, Ballig Farm, Glen Helen Road, Ballaspur, St Johns, German - Refused initially and at Review - Refused at Appeal 18th December 2003.

PA 02/851 Approval in Principle for the erection of a dwelling, Field 312447 – Refused on 3rd October 2002 and at Review on 9th December 2003

#### Inspector's conclusions PA 03/57

"...the Planning Committee suggested that the appellant should consider the possible conversion of an existing building located close to the farmhouse, if it is necessary to have additional accommodation. While the appellant makes clear that the building is not redundant it would be possible to consider that conversion as an annex to the main farmhouse. This would allow the appellant and his wife to live separately from their daughter but still run the business from one dwelling."

After considerable negotiation on this matter an application has been submitted to convert the stone barn and extend it to form 3 bedrooms, bathroom, kitchen and lounge. The east /gable elevation and the southern elevation are to be clad in stone to match the existing barn.

The existing corrugated sheds alongside the barn would be removed as part of the development. The accommodation would increase by 50%.

The highways division has objected suggesting that the visibility splays onto the TT Course are insufficient.

#### Given that:

- The highway's division did not express a formal objection for PA 03/57
- The persons who would occupy the additional accommodation are family members and already live in the house with their daughter, and
- The fact that the entrance has been used as a farm entrance for many years,

I do not agree that the highway's comments are valid.

In terms of the conversion and extension of the building, given the Inspector's comments, I think that it is reasonable to grant approval and is in line with the Planning Committee's advice under PA 03/57 on the review notice.

C 1. The development hereby permitted shall commence before the expiration of four years from the date of this notice.

C 2. This approval relates to drawing numbers 5095-11 Revision D, 5095-12, 5095-13 Rev B and 5095-14 Rev B.

C 3. The living accommodation herby permitted shall not be occupied at any time other than for purposes ancillary to the residential use of the dwelling known as Ballig Farm.

C 4. The windows and doors shall be timber framed.

C 5. The roof(s) must be finished in dark natural slate.

C 6. Prior to the commencement of works, details of how the entrance platform is to be raised must be submitted to and approved by the Planning Committee. Such works as approved must be carried out prior to the occupation of the accommodation hereby approved. [C.7] SC. 23 (Store work) [C.8] SC 24 (exohogstorework)

N 7. PRIOR to the commencement of any works the applicant is advised to consult the Chief Fire Officer to ensure that adequate fire precautions are taken. NS + N.9 - WATER STANDARD 2+3.
