In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby **APPROVE** the following application made on behalf of:

which was considered on 20 May 2005, subject to compliance with the conditions specified below.

### Schedule Of Conditions:

1. This approval is in principle only and will remain valid for a period of two years within which time no development may take place until such time as details of the reserved matters (siting, design, external appearance, internal layout, means of access, landscaping) have been approved by the Planning Authority. Such reserved matters should form the subject of a single application.

2. This approval relates to the principle of the erection of a dwelling within the area defined in red on the plan "A" received on 9th February, 2005. The domestic curtilage must be reduced to extend no further into the field than 40m from the main road.

Note: as this approval is being granted on the basis that it complies with the provisions of the 1991 Braddan Local Plan together with the provisions of Planning Circular 2/92, the development must not extend the boundary of the

existing settlement with the countryside. As such the rear boundary must define a curtilage which effectively joins that of "Fuchsia Cottage" with "Ballaveare Villa".

3. The application for reserved matters must demonstrate that a safe means of access to the site can be provided with visibility splays of 2.4m by 215m in both directions together with parking within the site for three car parking spaces and manoeuvring space to enable a motor vehicle to be driven in and out of the site both in a forward gear.

4. The property must be designed with traditional detailing: the sketch included in the application represents a satisfactory design although the chimneys should be centrally positioned on each gable and be of traditionally substantial proportions.

This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.

Note 1: This permission refers only to that required under the Town and Country Planning Acts and does not include any consent or approval under any other enactment, bylaw, order or regulation.

Note 2: No works may be commenced until such time as -
- the time for requesting a review of the initial decision has expired; or
- any review of the initial decision has been completed; or
- the time for requesting an appeal in relation to the decision has expired; or
- any appeal has been completed.
