## 1.0 Introduction

The purpose of the noise investigation is to advise planning in respect of compliance with noise conditions in the development order.

I cannot comment fully on this application due to the following:

1. The measurement positions and location of previous delivery point are not shown on the plan provided with report.

2. Neither the duration of delivery or measurement period are specified i.e. LAeq, 5 minute etc.

3. I have not had the opportunity to take measurements of noise from a delivery myself.

## 2.0 Comments

However, I would advise the following:

2.1 At location 1 an increase from 56 dB(A) to 61 dB(A) would on average sound significantly louder to a person but not twice as loud. 2.2 At location 2 an increase from 62 dB(A) to 73 dB(A) (11 dB) would on average sound twice as loud to a person. 2.3 If deliveries are less frequent and for a shorter period this would need to be considered in respect of any potential nuisance.

2.4 I am concerned that the reason noise levels have increase is due to the most common mistake in noise nuisance cases, location of noisy plant too close to noise sensitive premises.

2.5 These levels of noise could conceivably disturb residents sleep if deliveries are made at night.

2.6 These levels of noise could constitute a nuisance if over at least a 1 hour period, but under the Public Health Act 1990 Manx Gas would have the defence in law against statutory noise nuisance that 'best practicable means' have been taken for preventing it from being a nuisance.

2.5 Health & Safety of persons on site is only a concern if noise levels exceed 80 dB(A) and then generally only for durations of at least 8 hours per day. The higher the noise level above 80 dB(A) the shorter the duration that is of concern at that level. Noise at this site is not likely to be a Health & Safety concern.
