# Refusal Notices 2004 and 2005

## Town and Country Planning Acts, 1934 - 1991

### Isle of Man Planning Scheme (Development Plan) Order 1982

GCA Ltd
Carmodil Beg Studio
Glen Road
Ballaugh

In pursuance of powers granted under the above Acts and Order the Department of Local Government and the Environment does hereby REFUSE the following application made on behalf of:

**Name:** Mr & Mrs Brew
**Proposal:** Proposed replacement dwelling with integral garage
at:
Barnagh Farm
Rhencullen
Kirk Michael
IM6 2HB

which was considered on 10 March 2005, for the reasons set out below.

**Date of Issue:** 18th March, 2005
**Murray House Mount Havelock Douglas**
[Signature]
Secretary Planning Committee

### Reasons For Refusal:

1. The replacement dwelling, which would have a footprint and floor area significantly greater than the existing dwelling, and which would include basement parking would result in a dwelling of inappropriate scale and mass in this countryside location which is recognised as having High Landscape or Coastal Value and Scenic Significance. Such a dwelling which is in effect three storeys and which includes design features such as balconies, French doors and an irregular arrangement of windows, would replace what is a modest and simple, traditional, Manx cottage which relates well in terms of form and scale to the existing buildings within the group and also to its setting.

Whilst it is acknowledged that the site is set back from the public highway and set amongst a mature tree group, given that the site is in an elevated position and

given also the increased mass and size of the replacement dwelling, it is likely that the development will be more noticeable in the landscape when viewed from Kirk Michael Village. The Planning Committee thus judges that the scenic value and unspoilt character and appearance of the area would be harmed as a result.

NOTE This decision is based on the drawings submitted as part of the original application. The applicant / agent is encouraged to discuss any revised scheme such as that shown on the drawings submitted as part of the Review, with the Planning Officer.

NOTE This review has been considered by the Planning Committee on written evidence. Any additional submissions not previously circulated to interested parties are enclosed herewith.

Note 1: The decision contained in this notice does not become final until:-
- the time for requesting an appeal in relation to any decision at review has expired; or
- any appeal has been completed.

Note 2: Rights of appeal against the decision of the planning committee are attached.

Note 3: An appeal may be requested within a period of 21 days.
