### Officer's Report

There is a long planning history to the Bluebell Cottage. Once a garage, approval was granted at appeal under PA 99/2039 to convert the garage to tourist accommodation.

There is debate about whether the premises have ever been used for tourism, but it is now proposed to use the premises for permanent residential accommodation.

The appeal decision for PA 99/2039 stated in a note "having regard to the Minister's previous decision in relation to the application site, no further extension to the building or change of use to permanent accommodation in the future will be allowed."

The previous decision was PA 98/1019 for conversion and extensions to the garage. This was refused; the Inspector concluded, "the whole site would appear overdeveloped and cluttered and out of keeping with the surroundings."

### Planning History

i. PA 02/1825 - Erection of conservatory to rear of dwelling, summerhouse in garden and extension to potting shed, Bluebell Cottage, Patrick Road, St Johns, Patrick. The summerhouse and the extension to the potting shed were approved at Appeal and the conservatory was refused on 3rd September 2003 (see Appendix 1). ii. PA 02/1675 Amendments to bay extension to previously approved bay extension - approved. iii. 02/751 Installation of dormer window (former garage), Patrick Road, St Johns - refused at Appeal - 4th March 2003. iv. PA 01/1536 Installation of bay window to replace garage door and erection of boiler shed - approved at Appeal. v. PA 01/2520 The erection and creation of various garden features. Trellis and patio area approved. Wishing well, pergola, walling supports refused 29th April 2002. Approved at Review. vi. PA 01/1882 Erection of fence to rear of property, erection of rose trellis and amendment to PA 99/2039 to replace fan with the installation of a window. Approved 12th February 2002. vii. PA 01/422 Erection of boundary fence. Approved 10th August 2001. viii. PA 99/2039 Conversion of existing garage to holiday accommodation. Approved at Appeal 18th September 2001. ix. PA 98/1019 Conversion of garage including proposed extensions to dwelling - refused at Appeal x. PA 95/00658 Change of use of scrub land adjacent to Field 5270 to private garden, Bluebell Cottage. Approved at Appeal. Permitted Development Rights removed.

Since approval was granted to convert the garage, the garden to the rear of the building has matured and does not look cluttered or overdeveloped. A conservatory has been approved and a bay window has been added to the front elevation.

There have been continuous objections from the neighbours and the Commissioners about development on this site. They feel that it should remain as tourist use.

The unit falls within the 'predominantly residential' zoning on the St Johns Local Plan 1999.

Despite the planning history associated with this site, it is judged that the use of the site for residential purposes would not adversely affect the street scene, notwithstanding the Inspector's concerns set out in respect of PA 98/1019.

C 1. The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

C 2. Notwithstanding the provisions of the Town and Country Planning (Permitted Development) Order 1983 (or any Order revoking or re-enacting that Order) no greenhouses, walls, gates, fences, garden sheds, garages, or tanks for the storage of oil for domestic heating shall be erected (other than those expressly authorised by this approval.)

N 3. The Chief Fire Officer recommends the installation of mains wired interconnected domestic smoke detection.
