### Officer's Report

Kirk Michael Motors is on the corner of Station Road and Main Road, Kirk Michael. The site consists of a single storey building and larger workshop building both of which are accessed off Station Road.

The original approvals relate to use as a car showroom and workshop. It is proposed to use part of the car show room for the sale of garden machinery, equipment and plants including mowers, tools and compost and potted plants. The sale of motorcars is to cease but the garage will remain as it is. The applicant suggests of the total space available will be for garden sales, the remainder will stay unchanged i.e. service garage.

From an inspection of the site, some of these new uses appear to be already in existence. It is judged that considering the proposed scale of the operations, the two different uses are compatible.

Ideally, space for customer parking should be provided. However, if a vehicle was parked to the front of the garage it may be difficult to access such space. Indeed a second site visit revealed that there was a van parked to the front of the service garage which inhibited entry to the forecourt. There is on-street parking available and there is a public car park close by to the rear of the Bank.

Given the scale of the operations, it is judged that there will be no adverse impact on the street scene by proposed change of use of part of the building. The Highways Division raises no concerns about traffic and it is considered that any traffic generated by the development could be accommodated on the highway or in the public car park opposite.

## **C 1.**

The use must be taken up within four years of the date of this notice in order for this approval to remain valid after that time.

## **C 2.**

This approval relates to the drawings and supporting information submitted on 2nd April 2004.

## **C 3.**

This approval permits the use of the area described as 'car show room' on drawing number 1450/9 to be used for the sale of garden products such as lawnmowers, hand tools, compost and potted plants and the continuation of the area described as 'workshop' as a service garage.

## **C 4.**

The workshop may only be used as such between the hours of 8am and 6pm Monday to Saturday inclusive.

## **C 5.**

In event of this approval being taken up, all car sales from the premises must cease.
