Planning approval is sought to construct a replacement single storey dwelling on land to the west of Colby Glen Road, Arbory. The site is located within the designated Conservation Area, and whilst the

application refers to eth building on site as a derelict cottage, it is considered that the site still retains its residential use.

The dwelling proposed would be single storey with dormer accommodation to the rear. Timber frame sliding sash windows are also proposed, together with a slate roof. Access to the site would be via an amended access to the north of the site which allows for the parking and turning of vehicles within the site.

The proposal is considered to be acceptable, and without adverse impact on the character and amenity of the Conservation Area in which the site is located.

## **C 1.**

The development hereby permitted shall commence before the expiration of four years from the date of this notice.

## **C 3.**

No other works shall be commenced on site until the access with the adopted highway, including visibility splays, has been set out and established to the satisfaction of the Planning Authority after consultation with the Highway Authority.

## **C 4.**

The proposed development must be connected to the public foul sewer in a manner acceptable to the Department of Transport Drainage Division and on terms and conditions, which must be agreed with the Division PRIOR to the commencement of any building works. All drainage works must conform to the requirements of the Department of Transports "Manx Sewers for Adoption" and all necessary inspections/surveys [including CCTV] are to be carried out at the developer's expense. It is also a legal requirement under the Sewerage Act 1999 that the Department (as the drainage authority) be advised, in advance, of the date of the connection of each dwelling to the public sewer(s).

**NOTE:** A Communication Fee will be payable to the Department of Transport in respect of this communication.

C 5. There must be no discharge of surface water to the main foul sewer. C 6 . The proposed surface water discharge to the watercourse must be via a spillway, which must be constructed to Drainage Divisions specifications.

Prior to the commencement of works on site, those existing trees on site whose removal is not authorised by this approval must be adequately protected against damage during the course of construction, in accordance with the recommendations contained in British Standard 5837 (Section 8). The area between the trunk of each tree and the fencing shall thereafter be referred to as the Protected Area. After the completion of development works, the Protected Area must remain free from excavation or the deposit of materials.

PRIOR to the demolition of the cottage, a photographic survey of the dwelling and grounds must be undertaken, such photographs to be submitted to the Planning Authority.

N 8 . The applicant is advised that under section 35 of the Land Drainage Act 1934, permission is required from the Department of Transport for any works carried out on any watercourses throughout the Island. It is strongly recommended that the applicant contact the Drainage Division before works commence on site to discuss the proposed work on the riverbanks.
