### Officer's Report

This application is a resubmission of PA 03/1037 when planning permission was refused for the change if use of 11 Bank Street, Castletown from retail to residential. That application was refused on the grounds that the property was of a limited size, not suited to residential accommodation.

The applicant has resubmitted on the basis that the building was not properly previously surveyed and as such, is now found to be of a size that satisfies minimum standards. The applicant advises that the total floor area is 46 sq .m which is fractionally above the minimum standard for two persons in the 1984 Flats Regulations as being suitable for 2 persons. (the standard

being 45 sq. m ). The Chief Fire Officer maintains an objection to the development, and I am of the same view as the previous refusal. In addition, I also consider that the vitality and viability of Bank Street as a retail area would also be adversely affected by the loss of this unit to residential use.

R 1 . Notwithstanding the further information submitted regarding the floor area of the building, it is considered that the building would provide a poor environment for future occupier by reason of its size and limited outdoor amenity space.

R 2 . The loss of a retail unit at ground floor level would adversely affect the vitality and viability of Bank Street as a commercial/ shopping area as identified in the Castletown Local Plan.
