## Reasons For Refusal

Application Ref No: 04/00443/A

1. Whilst the Planning Committee recognises that it may be convenient to have someone living on the land off the Bollyn Road, the Planning Committee is not persuaded that there is real agricultural need to justify the erection of a new dwelling on this site. The establishment of such agricultural need is a requirement set out in Planning Circular 3/88 'New Agricultural Dwellings'.

The Planning Committee notes that the land off the Bollyn Road is one of two main pockets both owned and rented and that the applicant's current residence at Handley's corner is close to the other main pocket of land to the north of the T. T. Course near Cronk Y Voddy. The Committee also notes that Mr Christian owns a dwelling and 5 acres of land at Lambfell Beg to the to the south east of Cronk Y Voddy.

Whilst it has not been explained what would happen to the existing properties if a new agricultural dwelling was to be permitted, the Planning Committee judges that the existing dwelling at Handley's Corner which is between the two main pockets of land is in a convenient position to serve all of the existing land which is currently farmed and indeed the land at Cronk Y Voddy has been adequately served by this residence in the past. The Committee judges that the erection of a new dwelling is unwarranted and would fail to comply with the provisions of Circular $3 / 88$ which is in place to protect the Island's landscape from unnecessary development.
2. The Planning Committee is not persuaded that the applicant would comply with an agricultural worker's occupancy condition given that Mr Christian is not currently a full time agricultural worker. Policy 6 of Planning Circular 3/88 would not therefore be complied with.
3. This decision was made by the Planning Committee constituted in accordance with Paragraph 2 of Schedule 1 of the Isle of Man Planning Scheme (Development Plan) Order 1982.
